This paper focuses on the topic of evaluation of clinical ethics consultation. The concept of evaluation seems to contain an internal tension: On the one hand, evaluation is seen as distorting the conceptual and normative content of the case under scrutiny and, on the other, the evaluative act is the most important use of judgment and an inescapable part of everyday life. As such, we maintain that evaluation is essential.

Fetal ultrasonography has made women's and men's relationship to the fetus more equal. Drawing on information obtained from multiple conjoint interviews with 62 childbearing couples, I suggest that although women and men are both advantaged by fetal ultrasonography, expectant fathers' experience of the fetus is always enhanced, whereas pregnant women's experience may also be attenuated. For men, fetal ultrasonography is like a prosthetic device: an enabling mechanism that permits them access to a female world from which they have been excluded (...) because of their limited biological role in reproduction. For women, fetal ultrasonography is enabling, but it may also be a disabling mechanism that disrupts their privileged access to the fetus. (shrink)

We study the question of $\mathcal {L}_{\mathrm {ring}}$ -definability of non-trivial henselian valuation rings. Building on previous work of Jahnke and Koenigsmann, we provide a characterization of henselian fields that admit a non-trivial definable henselian valuation. In particular, we treat the cases where the canonical henselian valuation has positive residue characteristic, using techniques from the model theory and algebra of tame fields.

Driven by an impetus to standardize, numerous checklists have been devised to address quality in qualitative research, but these standards and the mindset driving them offer no language with which to speak about taste, or the aesthetic sensibilities that play such a key role in evaluating the goodness of any object. In this article, quality appraisal in qualitative research is considered in the context of taste, that is, in the discernment involved in judging the value of research and in the (...) recognition of the key role reviewer preferences, sensibilities and membership in one or more taste communities play in these judgements. The evaluation of a study is accomplished by evaluating one or more reports from that study, and such reports may be conceived as art forms amenable to the same criteria for appraisal as poems or paintings. Taste implies judgements about the quality of objects and a person's ability to sift through and select from a store of knowledge that knowledge appropriate to judge its value. What binds a community of practitioners (here reviewers of qualitative studies) together is taste‐making, or the constant refinements of judgements concerning what constitutes good and bad practice. Exploring the gender‐technology relation in nursingFeminist and nursing scholars have emphasized the critical role Western technology has played in the history and development of women and nursing. Yet, despite their common ground in tying both the emancipation and the subordination of women and nurses to technology, there has been virtually no association between nursing and gender‐technology studies. Gender‐technology studies offer nursing scholars new analytic directions and methodological tools to explore the nursing‐technology relation. When the original Dutch version of this book was presented in 1971 to the University of Leiden as a thesis for the Doctorate in philosophy, I was prevented by the academic mores of that university from expressing my sincere thanks to three members of the Philosophical Faculty for their support of and interest in my pursuits. I take the liberty of doing so now, two and a half years later. First and foremost I want to thank Professor G. Nuchelmans warmly (...) for his expert guidance of my research. A number of my most im portant sources were brought to my attention by him. During the whole process of composing this book his criticism and encouragement were carried out in a truly academic spirit. He thereby provided working conditions that are a sine qua non for every author who is attempting to approach controversial matters in a scientific manner, conditions which, however, were not easily available at that time. In a later phase I also came into contact with Professors L. M. de Rijk and J. B. Ubbink, with both of whom I had highly stimulating discussions and exchanges of ideas. <b>Objectives:</b> To gather empirical data on how gender and educational level influence bioethical reasoning among medical students by analyzing their use of care versus justice arguments for reconciling a bioethical dilemma. <b>Setting:</b> University Departments of Medical Ethics, Social and Communication Psychology in Germany. Participants: First and fifth year medical students. Design and method: Multidisciplinary, empirical, 2-segment study of ethics in action: In intrapersonal Segment 1, the students were presented with a bioethical dilemma and then administered a 13-item questionnaire to survey (...) their individual preferences for care versus justice arguments in resolving the conflict. The survey questioned 6 justice, 6 care-related items and 1 socially critical item. Data were analysed by gender and year of medical school. In interpersonal Segment 2, the bioethical dilemma from Segment 1 was discussed in gender-mixed and gender-homogeneous groups. Coded transcripts were evaluated to identify prevalences in care versus justice reasoning. <b>Results:</b> Data on 462 medical students were evaluable (n=338 in Segment 1, n=168 in Segment 2, n=44 overlap). Gender and level of education had no effect on moral reasoning in intrapersonal Segment 1, but significantly affected reasoning in interpersonal Segment 2, where women significantly tended to use more care-orientated arguments. Justice arguments predominated the group discussions. <b>Conclusion:</b> Interpersonal contexts affect moral reasoning in medical students, probably by amplifying the socialisation relating to gender and educational level. Care orientation is associated with the female gender. Professional socialisation tends to reduce the diversity and richness of moral reasoning towards a more justice-weighted orientation. Medical ethics should teach both justice and care reasoning modes in order to broaden physicians' ability to reconcile bioethical dilemmas. (shrink)

Este artigo pretende confrontar duas noções acerca da noção de liberdade, temática central na Filosofia Política. De um lado, partiremos de algumas reflexões do liberalismo político, onde no primeiro momento, exploraremos a obra Dois Conceitos de Liberdade, de Isaiah Berlin. Para esse autor a liberdade negativa e, não a liberdade positiva, deve ser a maior preocupação dos corpos políticos, ou seja, o Estado deve existir para evitar que a liberdade individual seja reduzida pela própria interferência do Estado ou de outros (...) sujeitos. De encontro a essa ideia, e ancorados em Arendt, desejamos sustentar que um dos grandes problemas do liberalismo político é a não ação, isto é, a falta de participação do cidadão nos assuntos e nas decisões políticas. Ao mostrar isso, defenderemos em Arendt o papel central da liberdade positiva da ação e da fala, e, consequentemente, a possibilidade de um republicanismo cívico como alternativa ao isolamento e apatia políticas gestados pela liberdade burguesa, uma vez que, para Arendt, a aposta de Berlin e da tradição liberal são insuficientes para pensarmos os acontecimentos da política contemporânea. The article addresses the school inclusion of children with Autism Spectrum Disorder (ASD), emphasizing the analysis of public policies in Brazil, the challenges faced, and the necessary strategies to ensure effective inclusive education. The central issue lies in the gap between the legislation that guarantees the educational rights of children with ASD, such as the Berenice Piana Law (Law No. 12,764/2012) and the Brazilian Inclusion Law (Law No. 13,146/2015), and its application in schools, where adequate infrastructure and teacher training are (...) still lacking. The objective is to investigate the barriers to implementing inclusion policies and propose solutions to make them effective. The methodology was qualitative and exploratory, with documentary data collection. The documents analyzed include the Salamanca Statement (1994), the National Policy on Special Education (2008), and international guidelines, such as those from the World Health Organization and the DSM-5, which provide theoretical foundations for ASD diagnosis. The results indicate that, although there have been significant legislative advances, such as the inclusion of children with ASD in regular schools, implementation remains insufficient. Issues such as a lack of teacher training and the absence of assistive resources in schools are significant barriers. It is concluded that, to overcome the challenges, a coordinated effort between governments, schools, and families is necessary, ensuring that public policies are translated into effective practices capable of promoting the holistic development of children with ASD. This article deals with the notion of jurisdictional discourse, which, as a specific type of complex discourse, always poses a real challenge to translators. The authors present a contrastive analysis of the texts of legal decisions in French, German and Polish in order to demonstrate the difficulties in translation and the consequences which they entail, and to suggest a strategy for overcoming them. Firstly, the authors briefly compare the texts of judicial decisions indicating their characteristics both in terms of the (...) macrostructure of the text and in terms of syntactic and lexical units. Secondly, they explain the origin of the difficulties in translation resulting from the qualitative differences of the legal systems. Thirdly, the different types of difficulties are described and illustrated by practical examples, in order to make experienced translators and apprentice translators sensitive to them. The corpus used for the analysis consists of the integral and documented texts of the French, German and Polish judgments rendered in matters of civil law [37]. It should also be noted that the analyzed texts are comparable texts, which are a valuable tool for translators and allow them to acquire means of expression that are as natural as possible [40]. Este artículo analiza el proceso de integración del Mercosur en el que participan Argentina, Brasil, Paraguay y Uruguay y sus efectos sobre la ciudadanía política y social. En la primera parte del mismo los autores examinan los rasgos, el contexto de nacimiento y la filosofía del proceso de integración mercosureño. La segunda parte analiza la evolución de la democracia y de la justicia social durante el proceso de integración. Los autores llegan a la conclusión de que el modelo de integración (...) mercosureño no puede contrarrestar la crisis de la democracia y de la justicia social que tienen lugar especialmente en Argentina y Brasil. In 2015 a team of scientists used a new gene-editing technique called CRISPR-Cas9 to edit the genome of 86 non-viable human embryos. The experiment sparked a global debate on the ethics of gene editing. In this paper; I first review the key ethical issues that have been addressed in this debate. Although there is an emerging consensus now that research on the editing of human somatic cells for therapeutic purpose should be pursued further; the prospect of using gene-editing techniques for (...) the purpose of human enhancement has been met with strong criticism. The main thesis that I defend in this paper is that some of the most vocal objections recently raised against the prospect of genetic human enhancement are not justified. I put forward two arguments for the morality of genetic human enhancement. The first argument shows how the moral and legal framework within which we currently claim our procreative rights; especially in the context of IVF procedures; could be deployed in the assessment of the morality and legality of genetic human enhancement. The second argument calls into question the assumption that the average level of human cognitive performance should have a normative character. (shrink)

Few views are as widely held as the Standard View of Identity. Here I am concerned with minority views that depart from the standard account. First, I attempt to illuminate such views and the debates concerning them by identifying the principles of identity at issue, articulating some of the assumptions underlying the debates, and presenting some of the evidence used against the Standard View of Identity. Second, I enter two of these debates myself. I first defend two Non-Standard Views of (...) Identity from the charge that they violate a principle of identity, namely the Transitivity of Identity. I then present an overlooked consequence of another Non-Standard View of Identity that challenges the view on one of its own methodological principles. Third, I draw on recent work in ontological and parthood pluralism to show how one might be led to think that there is more than one way of being identical. An increase in the number of older people with dementia is currently a trend around the world. In low and middle countries, effective public health services are not yet well‐developed, and family care‐givers may be overwhelmed by the requirements of care. This paper has two purposes: to share findings from an ethnographic study about family dementia care practices in Brazil and to draw attention to the significance of the materiality of care practices in the family context. The study was conducted (...) in Belo Horizonte, Brazil. We describe the care trajectory of one family and, analysing data using the insights of Actor Network Theory, show the significance of objects in a networked relation of care. In particular, we show how incontinence products such as adult diapers assume different positions in the network, acting as either mediator or intermediary of care in relation to other elements of the network composed of family members and their living situation, the person with dementia herself, the doctor, and Brazilian health policies. Although the diaper is often seen as an ordinary object for care providers, its participation in a care network shapes relations, activating conflict, financial constraint, and disciplining the body of the person with dementia. O objetivo deste artigo é apresentar a relação entre Filosofia política e democracia na obra de Michael Walzer, a partir da influência exercida sobre ele por John Rawls. Para fazer isto, será feita uma breve apresentação das visões de Rawls sobre aquela relação. Após, será mostrado que Walzer corrobora e amplia a concepção de Rawls. Por último, será descrito o papel de crítica imanente que Walzer atribui à Filosofia política nas democracias contemporâneas, trazendo-a da pretensão de guia da política, baseada (...) na contemplação privilegiada de qualquer suposta ordem transcendente e vinculante, para um papel de engajamento comprometido apenas com a própria ordem democrática. This article examines the data collected from the semi-structured interviews of nine Quebec elementary pre-service teachers in a practice teaching context. The paper exposes the educational goals inherent in the teaching of Social Studies, the place that this school subject occupies in the pre-service teacher’s practices, and its contribution to the development of the three-part mission of the Quebec school system (to instruct, socialize, and qualify). Even though Social Studies are considered by the participants of this study to be a (...) less important school subjects, they nevertheless remain significant. This importance refers mainly to the contribution of Social Studies to the development of socially acceptable attitudes in the student. It also refers to the development of an understanding and knowledge of history and of the functioning of society with the ultimate goal of adapting to this society. Sur la base des données issues des entrevues semi-dirigées réalisées auprès de neuf futurs enseignants du primaire en contexte de formation en milieu de pratique au Québec, l’article met en exergue les finalités sous-jacentes à l’enseignement des sciences humaines et sociales, la place que cette discipline occupe dans leurs pratiques ainsi que ses contributions au développement de la triple mission octroyée à l’école québécoise (instruire, socialiser, qualifier). Bien que les sciences humaines et sociales soient considérées par les participants à l’étude comme étant une discipline secondaire, elles restent somme toute importantes. Cependant, cette importance serait axée principalement sur la contribution des sciences humaines et sociales au développement chez les élèves d’attitudes socialement acceptables ainsi que sur le développement d’une connaissance et d’une compréhension qu’ils se font de l’histoire et du fonctionnement de leur société dans le but de s’y adapter. Nosso objetivo neste artigo é expor a maneira como Merleau-Ponty desenvolve, no texto “Nota sobre Maquiavel”, o argumento de que o pensamento político de Maquiavel é essencialmente humanista, uma vez que problematiza, entre outras coisas, as relações do homem com o homem e as relações dos homens com sua situação e com a história, tendo como fio condutor de tal problematização o papel a ser desempenhado pelo príncipe na direção do Estado e, consequentemente, das vidas de seus súditos.

This paper aims of is to present Richard Rorty’s Philosophy of Education, through his analysis of the education as being divided into two distinct processes: socialization and individualization. Thereafter, it is intended to show two critiques, of conservadorism and elitism, that are addressed to these processes. Finally, a redescription of the Rorty’s positions will be proposed, by assigning a reformist character to its apparent conservatism and a private character to the supposedly elitist individualization, in order to weaken the strength of (...) those critics. A partir de uma leitura integrada dos diálogos Fédon e Banquete, pretendemos revisar a interpretação tradicional de Platão como um filósofo que despreza o corpo e os sentidos, demonstrando que a filosofia platônica entrelaça amor, sensopercepção e saber. No Fédon, destacamos a importância das sensopercepções para a anamnese. No Banquete, apresentamos Éros como um impulso inerente à constituição humana, cujo desejo pelas coisas belas é capaz de elevar os indivíduos à contemplação das formas inteligíveis. Através da abordagem desses diálogos, torna-se (...) claro que Platão não defende um ascetismo radical, mas reconhece o corpo e o desejo como elementos fundamentais para a atividade filosófica, estabelecendo que o amor e a sensibilidade são condições de possibilidade para o acesso ao verdadeiro saber. Social Networking Sites (SNSs) not only enable users to read or create content about brands, but also to easily pass along this content using information diffusion mechanisms such as retweeting or sharing. While these capabilities can be optimal for viral marketing, little is known, however, about how reading brand messages passed along by SNS contacts influences online brand communication outcomes. Results of a survey with active SNS users indicate that (1) message evaluation, (2) the relationship with the sender, and (3) (...) the receiver’s opinion leadership and opinion-seeking levels influence not only the receiver’s intention to pass along the message further, but also his or her attitude towards the brand. The implications of these findings are discussed, including how these capabilities brought on by SNSs change the brand-consumer relationship online. (shrink)

Wie muss ein ethischer Beratungsdienst strukturiert sein, damit er in moralischen Konfliktsituationen im klinischen Alltag angefragt wird und die Ratsuchenden ergebnisorientiert unterstützen kann? Nach welchen Kriterien lassen sich die Beratungsgespräche auswerten und bewerten? Zur Beantwortung dieser Fragen werden theoretisch fundierte Konzepte ethischer Fallbesprechung aus Nimwegen, Leuven und Basel herangezogen; dies geschieht vor dem Hintergrund der Erfahrungen mit der über zehnjährigen Entwicklung der ethischen Arbeit im Ev. Krankenhaus Bielefeld (EvKB). Als Resultat stellen wir einen strukturierten, multidisziplinären Ansatz vor, mit dem in (...) den Beratungsgesprächen die ethischen Dimensionen unterschiedlicher Vorstellungen herausgearbeitet und möglichst einvernehmlichen Lösungen zugeführt werden. Am Beispiel des EvKB lässt sich zeigen, dass der ethische Beratungsdienst auch in Zeiten knapper Ressourcen implementiert und praktiziert werden kann und eine Gesprächskultur schafft, die zu neuen Zielvariablen führt; hier spielen der Perspektivenwechsel und die Prozessgerechtigkeit eine zentrale Rolle und liefern zugleich Ansatzpunkte für unsere eigene Evaluationsstrategie. Zum aktuellen Stand der Evaluation klinischer Ethikberatung wird die internationale Literatur kritisch gewürdigt. Erste konzeptionelle Ansätze und Ergebnisse einer eigenen Evaluationsstrategie werden vorgestellt. Durch die Offenlegung hoffen wir, die Auseinandersetzung mit diesen Themen zu intensivieren. (shrink)
